Allinmateappliances,clothing,footwear,andcommissaryproductswillbe;closelyinspectedtoensurethattheyarenotbeingusedtohide;contraband.;d. Allinmatebooks,magazines,andotherpaperswillbecloselyinspectedto;ensurethattheyarewithinthelimitforpapermaterials(1cubicfoot;maximum),theyarenotbeingusedtohidecontraband,andtheydonot;containevidenceofaplannedescape,disturbance,orothercrime.;e. Anyitemofcontrabandshallbeconfiscated.;AppellateCourtDecision:Carterv.State(SeeCourseContent);ProposedConsentDecree;WHEREASPlaintiffsJackJonesandJoeJohnsonhaveinitiatedthiscivilactionagainst;DefendantsAdelphiCountyJail,WardenPetePeters,SecurityChiefDanDawson,Shift;CommanderEdwardEngle,Sgt.BiffBelker,andOfficerArnieAnderson,alleging;violationsoftheirFourth,Fifth,andFourteenthAmendmentrights,and;WHEREASthepartieswishtoreachanamicableresolutionoftheissuesraisedherein;NOW,THEREFORE,thepartiesagreeasfollows;1. TheAdelphiCountyJailwillpayeachofthePlaintiffsthesumof$500.;2. TheAdelphiCountyJailanditsofficialsandemployeeswillconductinmatecell;searchesonlyinaccordancewiththefollowing;A. Aninmatecellsearchshallbeconducted;A.1);routinelywhen;A.1.a.a.;theinmateistobetransferredtoanothercell;housingunit,orfacility;A.1.a.b.;or;whentheinmateistobetransportedtocourt;A.1.a.c.;whentheinmateistobereleasedfrom;confinement.;2) randomlywhendirectedbytheShiftCommander,butonlyin;accordancewithatrulyrandomanddocumentedsystemof;selectioninvolvingmultiplepotentialcellsorhousingunits.;3) whenaninmateresidinginthatcellisreasonablysuspectedof;possessingcontraband,butonlyuponwrittenrequestto,and;authorizationfrom,theSecurityChief.;B. Aninmatecellsearchshallbeconductedasfollows;1) ThesearchshallbeconductedbyatleasttwoOfficers.;2) Ifaninmateresidinginthecellispresent,theinmateshallbe;removedfromthecellandplacedinrestraintsimmediatelyoutside;thecell.Ifaninmateresidinginthecellisnotinthecellbutis;presentinthejail,theinmateshallbesummonedandplacedin;restraintsimmediatelyoutsidethecell.Aninmateresidinginthe;cellshallbepermittedtoobservethecellsearchfromoutsidethe;cellunlesstheinmateisviolatinginmaterulesby,forexample;beingdisruptive,inwhicheventtheinmatewillberemovedto;administrativesegregationpendingdisciplinarycharges.;3) Allbeddingwillberemovedandthoroughlyinspectedfor;contraband.Followingtheinspection,thebedwillberemade.;4) Allinmateappliances,clothing,footwear,andcommissaryproducts;willbecloselyinspectedtoensurethattheyarenotbeingusedto;hidecontraband.;5) Allinmatebooks,magazines,andotherpaperswillbeclosely;inspectedtoensurethattheyarewithinthelimitforpapermaterials;(1cubicfootmaximum),theyarenotbeingusedtohide;contraband,andtheydonotcontainevidenceofaplannedescape;disturbance,orothercrime.;6) Anyitemofcontrabandshallbeconfiscated,theconfiscationshall;bedocumentedonaPropertyConfiscationform,andtheinmate;shallbechargedwithviolatinginmaterulesprohibitingthe;possessionofcontraband.;7) Allinmatepropertywillbetreatedwithrespectandallreasonable;effortswillbemadetoavoidunnecessarydamagetoinmate;property.;8) TheOfficersconductingthecellsearchshallprepareareportand;forwardsametotheShiftCommander.Ifthereportindicatesthat;contrabandwasconfiscated,theOfficersshallincludeacopyofthe;disciplinarycharges.Ifpossessionofthecontrabandconstitutesa;crime,theShiftCommandershallforwardthereporttotheWarden;whoshallthenconsiderwhethertoforwardthereporttotheStates;Attorney.;FormatRequirements;1.
